This article investigates the efficacy of a form of electoral innovation unique to the island-state of Singapore, the Nominated Member of Parliament scheme, and its impact on democratic governance, in light of the changing political landscape. A comparative perspective will be employed and broader conclusions on electoral engineering will be reached, especially for democratizing countries. Contrary to conventional scholarly wisdom, I argue that the NMP scheme can actually boost democratic representation in the country, considering the changing political landscape in the (...) state previously dominated by a hegemonic party. This is via two ways: firstly, NMPs could better represent the voices of the people at the margins of society and, secondly, they could be better positioned to raise issues that are deemed too to be raised by opposition parties. Japanese exhibits the Multiple Nominative Construction (MNC), where more than one nominative-marked NP appear within a single clause. Though the MNC has been extensively investigated in the syntax literature, its relation to rightward-displacement constructions has hardly been discussed. In the present article, we provide new sets of MNC data relating to the three types of right-displacement constructions: relatives, clefts, and postposing. The generalisation is that for the linearly ordered nominative-marked NPs in an MNC string, only the leftmost NP may (...) be right-displaced (that is, relativised, clefted, postposed). This pattern is shown to follow as an outcome of modelling incremental parsing, without stipulations specifically made for the observed data. We propose an account of MNCs in the light of an incremental grammar, formalising it within Dynamic Syntax. In this account, an MNC sentence is parsed on a word-by-word basis, and its interpretation is gradually built up, modelled as the growth of a semantic structure. In cases where a right-displacement is permitted, the right-displaced NP is successfully parsed against the structure built by the preceding part of the sentence. In cases where a right-displacement is disallowed, the right-displaced NP cannot be properly processed because the preceding part of the sentence has created no structural position into which the content of the right-displaced NP is reflected. As theoretical implications of the proposed account, we suggest the concept of time-linear grammaticality. (shrink)

The award-winning novel Convenience Store Woman by Sayaka Murata, first published in 2016 as コンビニ人間 (Konbini ningen), has received a lot of media attention from readers of both the original Japanese version and the English translation. For some, the novel depicts the wonder and vulnerability of a culture of convenience and conformity, while others have suggested that it highlights the gender discrimination faced by women in contemporary Japan. Yet the novel is ripe for analyses from other perspectives. This paper (...) presents one such new approach to analysing Murata’s Convenience Store Woman: its social-cum-auditory aesthetic. The theory of social aesthetics, developed by Arnold Berleant, essentially holds that there are perceptive values to be found not only in objects but also in social situations. The paper will argue that the convenience store’s environment – the social interactions, and soundscape presented in the novel – invokes and evokes a variety of aesthetic qualities, among them ‘acceptance’, ‘sensuousness’, and ‘reciprocity’. Combining a re-reading methodology and an application of Berleant’s social aesthetics theory, I will show how these sensibilities can be observed through the experiences of Keiko Furukawa, a life-long convenience store worker and the novel’s protagonist. Specifically, the focus will be on Keiko’s auditory sensibilities. (shrink)

This study examines the three major Japanese multinational corporate governance cases of the past decade: Sumitomo Copper, Daiwa Bank, and Mitsubishi Motors. The analysis focuses on three particular matters: Does senior management and the board exhibit a form of “disaster myopia”? Were there clear signs of the impending problems that were ignored? Is there anything distinctive that makes these cases Japanese in character? The first two questions are answered in the affirmative for all three firms, but only the (...) Nominalizations of modal predicates have received little, if any, attention in the semantic or philosophical literature. This paper will argue that nominalizations of modal predicates require recognizing a novel ontological category of modal objects and it will outline a new semantics of modals based on modal objects.

In this paper I will discuss certain cases in Japanese and Korean morphosyntax where forms compete to express the same semantic and grammatical information, and attempt to show that in each instance the most economical form is chosen. Presenting an account in terms of Optimality Theory (OT; see Prince and Smolensky (1993), Grimshaw (1995)), I will argue that constraints such as ‘Avoid Word’ and ‘Avoid Affix’ (as in (1)) are motivated as the forces behind the economization. (1) Avoid Word, (...) Avoid Affix. In OT, constraints are violable and ranked. For a given input—in this paper, abstract grammatical and semantic information—the optimal output is the morpho-syntactic expression which best satisfies the constraints in their ranking, even if some constraints are violated. If the constraints in (1) were the only forces on grammatical expression, the optimal output would be silence; but such an output would fail to express any of the information in the input. Hence, there are constraints on what is called ‘Faithfulness’ in OT, constraints which require linguistic material to faithfully express the abstract input information. In the next section of the paper, I discuss cases where a single word competes with a syntactic formation to express the same input information, illustrating a case where ‘Blocking’ extends from morphology into syntax. The term takyīf fiqhī stands for one crucial concept in Islamic jurisprudence and refers to one of the important steps in the process of formulating fatwā. It basically revolves around the categorization of particular issues under the appropriate rules and precedents established in Islamic juristic thought. The present article attempts to examine the concept of takyīf fiqhī in a comprehensive manner in terms of its meaning, authority, types, importance, and governing criteria as can be gleaned from the works of Sharī‘ah (...) scholars. This is then followed by an exploration of its application to modern contracts, taking as a case study the Central Provident Fund Nomination in Singapore. The article concludes with the view that the Central Provident Fund Nomination, in terms of its essential characteristics and objective, resembles the Islamic will contract as discussed in books of Islamic Jurisprudence. This article investigates the grammatical aspects of nominalization and the Japanese da predicate as critical strategies for realizing the effect of what I call `rhetorical ricochet' in Japanese discourse. The study explores the expressive function of the nominal/nominalizer and da in 28 imaginary letters appearing in asahi Shimbun as well as a literary text along with its English translation. I conclude that the combination of a certain kind of nominal/nominalizer and the da predicate reinforces the topic-comment relationship, (...) through which the rhetorical ricochet effect is realized. This study considers food commercials featuring the term otona, meaning ‘adult, mature person’. Although the term is not explicitly gendered, this study demonstrates that food advertising using otona becomes a conduit for the construction of gendered lifestyle formulations via consumption practices offering consumers entrance into a range of gendered adult life stage practices. Unlike the socially aspirational consumption practices described by Agha, the consumption of inexpensive otona-marked products, which cost the same as their non-otona-marked counterparts but are intended by commercial (...) producers to be viewed by prospective consumers as more mature, is linked to the process of entering adulthood. However, whereas male performance of otona masculinity is shown in the commercials to be based on psychological maturity and economic and social independence, female performance of otona femininity is determined by the commercial producers and the product manufacturers to be based on successful performance of external beauty, sexuality and support of male social sphere members. This article shows how otona becomes a catch-all for aspirational gendered performance, arguing that terms like otona are particularly suited for normative gendered performance presentations. A range of emergent studies have explored the idea of a renewed human-centered society, termed “Society 5.0,” and the role therein, of servant leadership. In this regard, in East Asian cultural contexts, existing scholarship does not yet provide sufficient theoretical and practical guidance for intercultural contexts, such as when a predominantly individualistic UK business culture interacts with generally collectivist Japanese culture. This is an important gap because if Society 5.0 is to be realized then a more in-depth intercultural contextual (...) appreciation and understanding are required. The study examines the UK/Japan setting and adopts a social constructivist epistemology and case study approach to illustrate dimensions of servant leadership (DSLs) manifesting in the lived experience of a UK business leader in Japan. Connections to business leader training are drawn and the importance of intercultural dyad specificity is highlighted. The study is also important because recent widespread exposure of various global corporate scandals creates a view that many business leaders care only for themselves or organizational profits, especially in individualistic-orientated societies. This original case study research herein commences the process of developing detailed and focal studies on underpinning drivers and raises hope that ethical behavior, as comprised in the DSLs, can potentially manifest in an individualistic UK/collectivist Japan intercultural dyad context. We are used to the idea that computers operate on numbers, yet another kind of data is equally important: the syntax of formal languages, with variables, binding, and alpha-equivalence. The original application of nominal techniques, and the one with greatest prominence in this paper, is to reasoning on formal syntax with variables and binding. Variables can be modelled in many ways: for instance as numbers (since we usually take countably many of them); as links (since they may `point' to a (...) binding site in the term, where they are bound); or as functions (since they often, though not always, represent `an unknown'). None of these models is perfect. In every case for the models above, problems arise when trying to use them as a basis for a fully formal mechanical treatment of formal language. The problems are practical—but their underlying cause may be mathematical. The issue is not whether formal syntax exists, since clearly it does, so much as what kind of mathematical structure it is. To illustrate this point by a parody, logical derivations can be modelled using a Gödel encoding (i.e., injected into the natural numbers). It would be false to conclude from this that proof-theory is a branch of number theory and can be understood in terms of, say, Peano's axioms. Similarly, as it turns out, it is false to conclude from the fact that variables can be encoded e.g., as numbers, that the theory of syntax-with-binding can be understood in terms of the theory of syntax-without-binding, plus the theory of numbers (or, taking this to a logical extreme, purely in terms of the theory of numbers). It cannot; something else is going on. What that something else is, has not yet been fully understood. In nominal techniques, variables are an instance of names, and names are data. We model names using urelemente with properties that, pleasingly enough, turn out to have been investigated by Fraenkel and Mostowski in the first half of the 20th century for a completely different purpose than modelling formal language. What makes this model really interesting is that it gives names distinctive properties which can be related to useful logic and programming principles for formal syntax. Since the initial publications, advances in the mathematics and presentation have been introduced piecemeal in the literature. This paper provides in a single accessible document an updated development of the foundations of nominal techniques. This gives the reader easy access to updated results and new proofs which they would otherwise have to search across two or more papers to find, and full proofs that in other publications may have been elided. The State of Emergency declaration in Japan due to the COVID-19 pandemic affected many aspects of society in the country, much like the rest of the world. One sector that felt its disruptive impact was education. As educational institutions raced to implement emergency remote teaching (ERT) to continue providing the learning needs of students, some have opened to innovative interventions. This paper describes a case of ERT where Filipino vocabulary was taught to a class of Japanese students taking (...) Philippine Studies in a Japanese university using a cognitive innovation based on virtual reality, an immersive technology often researched for immersion and presence. Students were divided into three groups to experience six lessons designed around virtual reality photo-based tours at different immersion levels. While the effect of immersion on satisfaction was not found to be statistically significant, presence and satisfaction were found to be correlated. Despite challenges that were encountered, benefits like enjoyment, increased engagement, and perceived learning were reported by the students. Our findings exemplify how emerging multisensory technologies can be used to enhance affective and cognitive dimensions of human experience while responding to gaps created by the spatial limitations of remote learning. This article examines the case of institutional inertia in Japanese financial regulation, focusing on the reasons why institutions centered on informal modes of organization and interaction proved particularly The Japanese case serves as a particularly tough test for theories of institutional adaptation and change because even crisis failed to produce timely institutional change. The paper argues that informal, exclusionary and opaque relational ties served as a functional substitute for formal regulation and promoted cooperative government-bank relationships in (...) an earlier period. Yet, when the informal attributes of the system began to impede the sound functioning of the financial system, the very opacity of these ties and the informational dynamics underlying them meant that the Diet and the general public were less than fully aware of the extent of dysfunction present as time went on. Based on an empirical illustration of Onta pottery and more broadly a discussion of the Japanese Mingei movement, we study the intimacy between craft work, ethics and time. We conceptualize craft work through the temporal structure of tradition, to which we find three aspects: generational rhythms of making; cycles of use and re-use amongst consumers and a commitment to historically and naturally attuned communities. We argue these temporal structures of tradition in craftwork are animated by two contrasting but co-existing (...) ideas of the good: the moral and the ethical. By developing the work of Elizabeth Grosz, we conceptualize this distinction between moral and ethical as a temporal phenomenon, specifically in differing relations to ideas of the future. Moral aspects of craft work understand the future as a progression from past, whether in preserving practices and norms, or improving upon them in relation to ideals. Ethical aspects understand the future as inherently open to chance and divergence, valuing difference, accident and the possibilities for creativity these entail. Empirically, we show evidence of both aspects in the case of Mingei—a organized movement dedicated to preserving and promoting traditional Japanese craft work. We contribute to studies of craft work by revealing and classifying its temporal aspects. We contribute to studies in business ethics by conceptualising a generative distinction between morals and ethics configured through differing understandings of time. (shrink)

In this article, we develop a hierarchical Bayesian model of learning in a general type of artificial language‐learning experiment in which learners are exposed to a mixture of grammars representing the variation present in real learners’ input, particularly at times of language change. The modeling goal is to formalize and quantify hypothesized learning biases. The test case is an experiment (Culbertson, Smolensky, & Legendre, 2012) targeting the learning of word‐order patterns in the nominal domain. The model identifies internal biases (...) of the experimental participants, providing evidence that learners impose (possibly arbitrary) properties on the grammars they learn, potentially resulting in the cross‐linguistic regularities known as typological universals. Learners exposed to mixtures of artificial grammars tended to shift those mixtures in certain ways rather than others; the model reveals how learners’ inferences are systematically affected by specific prior biases. These biases are in line with a typological generalization—Greenberg's Universal 18—which bans a particular word‐order pattern relating nouns, adjectives, and numerals. (shrink)

In _The Curious Case of the Camel in Modern Japan_, Ayelet Zohar addresses issues of Orientalism, colonialism, and exoticism in modern Japan, through images of camels – the epitome of Otherness, and a metonymy for Asia in the Japanese imagination.

In Japan, discussion concerning advance directives (ADs) has been on the rise during the past decade. ADs are one method proposed to facilitate the process of communication among patients, families and health care providers regarding the plan of care of a patient who is no longer capable of communicating. In this paper, we report the results of the first in-depth survey on the general population concerning the preferences and use of ADs in Japan. A self-administered questionnaire was sent via mail (...) to a stratified random sampling of 560 residents listed in the residential registry of one district of Tokyo, Japan (n = 165,567). Association between correlating factors and specific preferences toward ADs was assessed using contingency table bivariate analysis and multivariate regression model to estimate independent contribution. Of the 560 questionnaires sent out, a total of 425 participants took part in the survey yielding a response rate of 75.9 %. The results of the present study indicate that: 1) the most important components to be addressed are the specifics of medical treatment at the end of life stage and disclosure of diagnosis and prognosis; 2) the majority of participants found it suitable to express their directives by word to family and/or physician and not by written documentation; 3) there is no strong need for legal measures in setting up an AD; 4) it is permissible for family and physician to loosely interpret one's directives; 5) the most suitable proxy is considered to be a family member, relative, or spouse. Multivariate analysis found the following five factors as significantly associated with preferences: 1) awareness regarding living wills, 2) experience with the use of ADs, 3) preferences for end-of-life treatment, 4) preferences for information disclosure, and 5) intentions of creating a will. Written ADs might be useful in the Japanese setting when the individual either wishes: 1) to not provide a lot of leeway to surrogates and/or caregivers, and/or 2) to ensure his or her directives in the cases of terminal illness, brain death, and pain treatment, as well as regarding information disclosure. How is a terminally ill patient treated by the surrounding people in the U.S. and Japan? How does a terminally ill patient decide on his or her own treatment? These questions will be examined in a study of intensive medical care, received by a terminally ill Japanese cancer patient in the U.S. and Japan. This casereflects the participant observation by a Japanese anthropologist for about 8 years in the United States and Japan on one patient who was hospitalized (...) in both countries on and off for about eight years. The objective of this study is to illuminate the different concept of personhood between the U.S. and Japan that appeared in different cultural practices of both countries and in the subject’s own decision making process. The significant differences appeared between theU.S. and Japan in the concepts of (1) science, (2) suffering, (3) Power of Attorney and Doisho (Consent Form), and (4) organized care. The interpretation of such differences indicates that seemingly universal practices across countries suggest cultural specific concepts and their management. Therefore, ethical norms appeared differently accordingly to each country. (shrink)

Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. The key insight is that their semantic arguments are themselves set intersections: the restrictor is the intersection of the predicates denoted by the N’ or the V’ and the restricted universe, U, and the scope is the intersection of the N’ and V’. Following Cohen, I assume that the universe consists of the union of alternatives to the (...) nominal and verbal predicates, where an alternative to a property ψ is one that shares a pragmatic presupposition with ψ, and a pragmatic presupposition is one that is selected by context from a set of potential presuppositions associated with the sentence. A many/few-quantified sentence is then true iff the proportion of the scope to the restrictor is greater/less than some threshold, n. In addition to explaining various problematic cases from the literature, the analysis shows how the readings of a many/few-quantified sentence can be derived from the same syntactico-semantic structure, it being unnecessary to claim lexical or structural ambiguity. Specifically we read that traditional Japanese aesthetics is an (...) aesthetics of imperfection, insufficiency, incompleteness, asymmetry, and irregularity, not to mention perishability, suggestiveness, and simplicity.1 Given this collection of qualities, we are presented with a matching set of paradigmatic Japanese aesthetic experiences and objects, both as illustrations and as legitimations of this close-to-standard portrait. Examples include the suggestive moon covered by drifting clouds, the irregularly formed ceramics of ceremonial teacups, the simple and asymmetrical arrangement of unpolished rocks in the dry landscape garden, the bold and dashing monochromatic strokes typical of Zen calligraphy, transient cherry blossoms, serene and cloud-capped mountain summits, lonely thatched huts, sunsets in the foggy twilight, the call of a crane that breaks through the silence, and the light autumn rain that drizzles upon a secluded pond.Upon further reflection, it becomes noticeable that some familiar Japanese aesthetic objects do not easily conform to this standard picture, and this raises doubts about the typical characterization of Japanese aesthetics. The quintessentially Japanese shōji screens and tatami mats, for instance, are uniformly rectangular rather than irregular in form. They are, moreover, neither asymmetrical, nor imperfect, nor incomplete, nor insufficient. How then, can these perfectly regular screens and mats—items crucial to the aesthetics of Japanese domestic architecture—fit neatly into the usually encountered portrait of traditional Japanese aesthetics, if it is said to be fundamentally "the worship of imperfection"?2 Or similarly if "imperfection" is [End Page 88] the keynote of this aesthetics, how does one explain the meticulously raked surfaces of the dry landscape garden or the impeccably perfected movements requisite for performing the Japanese tea ceremony?3Since such examples do not obviously fit into an "aesthetics of imperfection and insufficiency," some reconsideration of the prevailing characterization of Japanese aesthetics is needed to accommodate these, along with other examples of "perfected" items and arrangements. In short, the main difficulty is that the concept of "perfection" has been underthematized.4 To develop a revaluation of the presently submerged status of "perfection" in most scholarly discussions of Japanese aesthetics, I will highlight the familiar principle of aesthetic complementarity but contextualize the experiential foundations of this principle in a specifically Japanese-philosophic manner, namely, in reference to a fundamental feature of time-consciousness, as described by Dōgen (1200-53). This historical grounding will align the principle of complementarity with some of the acknowledged Zen Buddhist sources of traditional Japanese aesthetics.5 The upshot will be that the above-cited collection of adjectives typically used to describe the prevailing atmosphere of Japanese aesthetics—imperfection, asymmetry, incompleteness, suggestibility, etc.—presents only half of the aesthetic and philosophic story and, moreover, tends to pass over what can be appreciated as a more consequential underlying concept, namely, the idea of "contingency."In what follows, basic reflections on the phenomenology of time-consciousness will lead to the claim that, in many paradigmatic instances of traditional Japanese aesthetics, we have before us a situation that is aptly describable as "the idealization of contingency." This involves the assertion of a philosophic proposition through an aesthetic presentation (i.e., the proposition is expressed using metaphor, symbolism, or analogy). The dilemma of whether and how to disclose a diagnosis of cancer or of any other terminal illness continues to be a subject of worldwide interest. We present the case of a 62-year-old Japanese woman afflicted with advanced gall bladder cancer who had previously expressed a preference not to be told a diagnosis of cancer. The treating physician revealed the diagnosis to the family first, and then told the patient: "You don't have any cancer yet, but if we (...) don't treat you, it will progress to a cancer". In our analysis, we examine the role of family consent, communication patterns (including ambiguous disclosure), and advance directives for cancer disclosure in Japan. Finally, we explore the implications for Edmund Pellegrino's proposal of "something close to autonomy" as a universal good. (shrink)

The diachronic change of word-formation patterns is currently gaining increasing interest in cognitive-linguistic and constructionist approaches. This paper contributes to this line of research with a corpus-based investigation of nominalization with the suffix -ung in German. In doing so, it puts forward both theoretical and methodological considerations on morphology and morphological change from a usage-based perspective. Regarding methodology, the long-standing topic of how to measure the productivity of a morphological pattern is discussed, and it is shown how statistical association (...) measures can be applied to quantify the relationship between word-formation patterns and their bases. These findings are linked up with theoretical considerations on the interplay between constructional schemas and their respective instances. (shrink)

The qirāʾāt or variae lectiones represent the vast corpus of Qurʾānic readings that were preserved through the historical processes associated with the textual codification and transmission of the Qurʾān. Despite the fact that differences among concomitant readings tend to be nominal, others betray semantic nuances that are brought into play within legal discourses. Both types of readings remain important sources for the history of the text of the Qur’ān and early Arabic grammatical thought. While some recent scholars have questioned the (...) historical function and nature of the corpus of qirāʾāt, others have argued that specific types of variant readings were the resultant products of attempts to circumvent legal inconsistencies which were found in text of the Qurʾān or were generated through legal debates. Following a preliminary review of the historical framework of the genesis of qirāʾāt through reference to early grammatical literature, an attempt will be made to shed some light on the role that semantic variation among concomitant readings played in the synthesis and interpretation of law. The aim will be to draw attention to the subtle theoretical frameworks employed by jurists for their contextualization and analysis. This will also include a review of attitudes towards the forms of qirāʾāt that classical scholarship designated as being anomalous or shādhdha. (shrink)

Critics and champions alike have fussed and fretted for well over fifty years about whether Russell’s treatment is compatible with certain alleged acceptable uses of incomplete definite descriptions,[2] where a description (the F( is incomplete just in case more than one object satisfies its nominal F, as in (1).

This article examines the problem of agency in resident–staff interaction in a Japanese eldercare facility. Data were collected during the morning care routines and analysed within the framework of Conversation Analysis. Focusing on the openings and closings, I show that the interactions in the setting under observation are marked by a clear dominance of the care workers. This becomes most obvious at the level of the turn-taking system, where the first pair part of a new sequence is commonly delivered (...) by a care worker, thus assigning a mainly reactive role to the residents. However, the data also contain instances where this pattern is broken up by a reversal of the turn structure. I show how this sequential re-organisation enables a resident to take a more proactive role in determining the relevant next action, arguing that there is much potential for higher resident agency even in routine interactions such as the morning care activities. I also discuss the practical implications of these findings for care communication in general. (shrink)

This study introduced a phenomenological approach to the study of the companies that committed corporate crimes. The author first developed the epistemology of normative control which is based on the philosophical ground of phenomenology, sociology of knowledge, ethnomethodology, Habermas's normative theories, and Foucault's normalizing discourse in the context of organizations. He, then, showed the procedures for conducting a qualitative and phenomenological empirical case study of an aggressive Japanese company whose name appeared in the media for its scandal in (...) Tokyo. The inquiry revealed the generative mechanism of normative control and the patterns of constructing social reality of workplaces in a Japanese company. (shrink)

The primary goal of this paper is not to argue for the “influence” of Cassirer, but rather to make known the reception of Cassirer in Japanese philosophy, illustrate the interconnection between Cassirer’s critique of culture and that of Japanese philosophy, and hopefully spark interest in what might be a fruitful dialog between Cassirer scholars and those working in Japanese philosophy. Historically, the paper defines Japanese philosophy and makes known its engagement with Western philosophy and the Marburg (...) school of neo-Kantianism and its project of a critique of culture during its own self-development. Systematically, the paper points to the possible interconnection between Cassirer’s critique of culture and that of Japanese philosophy and makes the case for a mutually productive dialog between Cassirer scholars and those working in Japanese philosophy. Implicitly, the paper attempted to show that an engagement with Japanese philosophy from the perspective of a critique of culture forces us to question the Western dichotomy between philosophy and religion and the importance of this for the further development of a non-Eurocentric critique of culture. And by extension, that a critique of culture must be cognitive of the historicity of the culture from which it speaks. (shrink)

Infectious disease outbreaks in residential care are complex to manage and difficult to control. Research in this setting that includes individuals who lack capacity must conform to national legislation. We report here on our study that is investigating outbreaks of scabies, an itchy skin infection, in the residential care setting in the southeast of England. There appears to be a gap in legislative advice regarding the inclusion of people who lack capacity in research that takes place during time-limited acute scenarios (...) such as outbreaks. We received inconsistent advice from experts regarding, in particular, the role of nominated consultees. There is a potential inequality for vulnerable populations who cannot themselves provide informed consent in terms of their access to participation in a range of health-related research. (shrink)

Despite decades of research on the reconstruction of proto-Korean-Japanese (pKJ), some scholars still reject a genetic relationship. This study addresses their doubts in a new way, interpreting comparative linguistic data within a context of material and cultural evidence, much of which has come to light only in recent years. The weaknesses of the reconstruction, according to J. Marshall Unger, are due to the early date at which pKJ split apart and to lexical material that the pre-Korean and pre-Japanese (...) branches later borrowed from different languages to their north and south, respectively. Unger shows that certain Old Japanese words must have been borrowed from Korean from the fourth century C.E., only a few centuries after the completion of the Yayoi migrations, which brought wet-field rice cultivation to Kyushu from southern Korea. That leaves too short an interval for the growth of two distinct languages by the time they resumed active contact. Hence, concludes Unger, the original separation occurred on the peninsula much earlier, prior to reliance on paddy rice and the rise of metallurgy. Non-Korean elements in ancient peninsular place names were vestiges of pre-Yayoi Japanese language, according to Unger, who questions the assumption that Korean developed exclusively from the language of Silla. He argues instead that the rulers of Koguryo, Paekche, and Silla all spoke varieties of Old Korean, which became the common language of the peninsula as their kingdoms overwhelmed its older culture and vied for dominance. Was the separation so early as to vitiate the hypothesis of a common source language? Unger responds that, while assuming non-relationship obviates difficulties of pKJ reconstruction, it fares worse than the genetic hypothesis in relation to non-linguistic findings, and fails to explain a significant number of grammatical as well as lexical similarities. Though improving the reconstruction of pKJ will be challenging, he argues, the theory of genetic relationship is still the better working hypothesis. The Role of Contact in the Origins of the Japanese and Korean Languages shows how an interdisciplinary approach can shed light on a difficult case in which the separation of two languages lies close to the time horizon of the comparative method. Old Avestan, like other Old Indo-Iranian languages, appears to attest a variety of nouns and adjectives that display “verbal” government of accusative case “objects.” However the existence of such “transitive” nominals is problematic from a formal linguistic perspective, and indeed some formal linguistic models have denied their existence. In this paper I reconsider both the formal arguments concerning transitive nominals and the Old Avestan evidence, with the aim of establishing a more precise analysis of this aspect of Old Avestan (...) syntax. Background In Japan, discussion concerning advance directives (ADs) has been on the rise during the past decade. ADs are one method proposed to facilitate the process of communication among patients, families and health care providers regarding the plan of care of a patient who is no longer capable of communicating. In this paper, we report the results of the first in-depth survey on the general population concerning the preferences and use of ADs in Japan. Method A self-administered questionnaire was sent (...) via mail to a stratified random sampling of 560 residents listed in the residential registry of one district of Tokyo, Japan (n = 165,567). Association between correlating factors and specific preferences toward ADs was assessed using contingency table bivariate analysis and multivariate regression model to estimate independent contribution. Results Of the 560 questionnaires sent out, a total of 425 participants took part in the survey yielding a response rate of 75.9 %. The results of the present study indicate that: 1) the most important components to be addressed are the specifics of medical treatment at the end of life stage and disclosure of diagnosis and prognosis; 2) the majority of participants found it suitable to express their directives by word to family and/or physician and not by written documentation; 3) there is no strong need for legal measures in setting up an AD; 4) it is permissible for family and physician to loosely interpret one's directives; 5) the most suitable proxy is considered to be a family member, relative, or spouse. Multivariate analysis found the following five factors as significantly associated with preferences: 1) awareness regarding living wills, 2) experience with the use of ADs, 3) preferences for end-of-life treatment, 4) preferences for information disclosure, and 5) intentions of creating a will. Conclusions Written ADs might be useful in the Japanese setting when the individual either wishes: 1) to not provide a lot of leeway to surrogates and/or caregivers, and/or 2) to ensure his or her directives in the cases of terminal illness, brain death, and pain treatment, as well as regarding information disclosure. Healthcare is becoming increasingly automated with the development and deployment of care robots. There are many benefits to care robots but they also pose many challenging ethical issues. This paper takes care robots for the elderly as the subject of analysis, building on previous literature in the domain of the ethics and design of care robots. Using the value sensitive design approach to technology design, this paper extends its application to care robots by integrating the values of care, values that (...) are specific to AI, and higher-scale values such as the United Nations Sustainable Development Goals. The ethical issues specific to care robots for the elderly are discussed at length alongside examples of specific design requirements that work to ameliorate these ethical concerns. (shrink)

This study investigates the choice of genitive forms (the woman’s book vs. the book of the woman) in the English of Japanese-English bilingual returnees (i.e. children who returned from a second language dominant environment to their first language environment). The specific aim was to examine whether change in language dominance/exposure influences choice of genitive form in the bilingual children; the more general question was the extent to which observed behaviour can be explained by cross linguistic influence (CLI). First, we (...) compared the choice of genitive form between monolingual Japanese speakers and bilinguals who had recently returned to Japan from an English monolingual environment. Second, we tracked changes in genitive preference within bilingual children, comparing their performances upon return to Japan to those of one year later. Results show that CLI alone is insufficient to explain the difference in genitive evaluation between bilinguals and monolinguals, as well as the intra-group bilingual variation over time. We suggest that both CLI and general processing considerations couple together to influence the changes in genitive preference. (shrink)

Inequality in the family is the most damaging of all forces in women’s lives. It is overtly preserved by religious, customary, and state laws that formally enshrine discrimination against women and is perpetuated by de facto lack of access to nominally protective systems and remedies. International law and its implementation mechanisms provide an arena for confronting resistance to gender equality in the family, calling states to account at the highest level as well as providing a platform for domestic advocacy. CEDAW (...) and the jurisprudence of its monitoring body, the Committee on the Elimination of Discrimination against Women, clearly state the paramount value of protecting the individual human rights of family members rather than maintaining family “protection” and privacy at the expense of the women within it. By ratifying, States theoretically commit themselves to this progressive position. However, the politics of state and community identity make for a more complex picture that includes multiple, sometimes overlapping, levels of acceptance and rejection. Taking as a case study the current initiative to adopt a new General Recommendation to address the economic consequences of family relations and their dissolution, this Article draws on the CEDAW Convention and the CEDAW Committee’s work to suggest a practical application of international standards to address the tangle of legal systems and identity that have disadvantaged women for centuries. Placing this initiative within the context of multiple family law regimes and the multicultural debate, the right to exit and the concept of freedom to associate and to disassociate are emphasized as crucial in confronting the phenomenon of discriminatory identitybased family legal regimes. The Article concludes with an illustration of the harmonization process required by the CEDAW Convention, taking the new General Recommendation as a model approach for meeting the international equality norms while preserving community or State identity. This article examines the practice of "co-participant completion" in Japanese conversation, and explores what kinds of resources are mobilized to provide the opportunity to complete another participant's utterance-in-progress. It suggests the following observations as potential characteristics of Japanese co-participant completion: (i) Syntactically-defined two-part formats (e.g. [If X] + [then Y]) may not play as prominent a role as in English; (ii) The majority of cases of co-participant completion take the form of 'terminal item completion;' (iii) Locally emergent structures (...) like 'contrast' and 'list' as well as 'unprojected' features of turn construction often play an important role in enhancing the opportunity for completing another participant's utterance-in-progress. The article then discusses the implications of these findings for the investigation of the mutual bearing of grammar and social interaction. In particular, the discussion focuses on what we can learn from the practice of co-participant completion about how projection of turn-shapes is accomplished in Japanese conversation. (shrink)
